OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY
Open to international Participants who are 18 years of age or older as of Tuesday, July 7, 2009 and where not prohibited by law. Void in Puerto Rico and elsewhere prohibited by law. Contest begins Tuesday July 7, 2009 at noon, and all entries must be received by 11:59 P.M. EDT (GMT-4) on Monday, November 30, 2009. All times are Eastern Time. The winners will be selected on or about Monday, December 14, 2009.
HOW TO ENTER
Participants must complete the online entry form at http://www.positive-way.com/Contest.htm and submit the entry via the form. Read and completely fill out all fields in the entry form and submit your entry (Minimum 250 words and maximum 1,200 words) in the form. No other form of entry will be accepted other than those submitted through this form. The entry must be an original work by the participant.
Each contest entry must be received by 11:59 P.M. EDT on Monday, November 30, 2009. Once submitted, entries become the sole property of Sponsor. Entry to this contest constitutes acceptance of these terms and conditions. One entry per person.
The Positive Way (Sponsor) is not responsible for lost, interrupted, or unavailable network, server, or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical, or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, stolen, misdirected, or illegible. Entry materials/data that have been tampered with or altered are void. Incomplete entries are deemed invalid.
The odds of winning are determined by the number of participants who submit valid entry forms.
SELECTION OF WINNER AND JUDGING CRITERIA
All eligible entries will be judged by The Positive Way staff. The judges will choose up to ten winners from all the eligible entries received for duration of the contest. The judging criteria to be used in selecting the Finalists will be (1) 60 percent relevancy of the answer to the contest question and (2) 40 percent the estimated appeal of the answer to other readers. The winners of the contest will be notified approximately two weeks after the closing of the contest, on or about Monday, December 14, 2009, via email. The winners of the contest will be posted on the site on or about Thursday, December 31, 2009. By participating, entrants agree to the Official Rules and the decisions of the judges, which shall be final and binding in all respects.
CONTEST PRIZES
The prize winners are eligible to receive publication online and the following:
First Prize: $100 US plus a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Second Prize: $50 US plus a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Third Prize: $25 US plus a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Fourth Prize: $15 US plus a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Fifth Prize: $10 US plus a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Sixth Prize: a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Seventh Prize: a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Eighth Prize: a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Ninth Prize: a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Tenth Prize: a copy of the e-book Talk to Me: How to Create Positive Loving Communication or Priceless Life Lessons (approximate retail value $12.95).
Cash prize payments will be made via PayPal Internet funds transfer only. It is the responsibility of the entrant to provide a valid email address to which PayPal funds may be sent. Further it is the responsibility of the entrant to pay any fees that PayPal may charge for the delivery of the cash prize. Thus a cash prize will be the net amount of the prize awarded by Sponsor less any fees.
All e-book prizes will be delivered via email to the email address provided by the participant on the entry form.
Prizes will be awarded within approximately 30 days after selection of winner. No substitution allowed except at discretion of the Sponsor. Sponsor reserves the right to substitute any and all prizes with prizes of equal or greater value, if an advertised prize becomes unavailable. Prizes are non-transferable. No substitution or cash equivalent offered except at Sponsor's option. Any and all taxes and fees are the responsibility solely of the winners. Sponsor is not responsible for any failure of the Participant email account to accept communication and/or prize delivery.
ELIGIBILITY
Contest is governed by U.S. law and is open only to international participants who are 18 years of age or older as of Tuesday July 7, 2009 and where not prohibited by law. Void in Puerto Rico and elsewhere where prohibited by law. Employees or agents of The Positive Way are ineligible. All federal, state, and local laws and regulations apply. Participants are responsible for assuring compliance with the laws of the jurisdiction in which they reside.
CONDITIONS OF PARTICIPATION
Winners may be required to sign and return an Affidavit of Eligibility, a Liability Release, to provide a valid postal mailing address, and, where legal, a Publicity Release within seven (7) days of the date printed on the prize notification or be disqualified. Winner will be notified by e-mail and must respond within seven (7) days of attempted notification or be disqualified. If a prize is returned as undeliverable, potential winner will be disqualified. Sponsor reserves the right, in its sole discretion to cancel, terminate, or suspend the contest should viruses, bugs, unauthorized human intervention, or other causes beyond the control of Sponsor corrupt or impair the administration, security, or fairness of the contest. In such event, winner will be selected from all eligible entries received up to the time of such cancellation, termination, or suspension. The Sponsor reserves the right, in its absolute discretion, to terminate, suspend, or amend the Contest or to amend the Official Rules at any time and in any way, without prior notice for any reason whatsoever.
All entries must be written in the English language. No poetry will be accepted. No offensive language or writing will be accepted.
By entry Participants certify that the submission is a previously unpublished original creative work by the Participant. All entries become the property of Sponsor on submission. Submission of an entry constitutes the irrevocable grant to Sponsor of all rights in the entry, all rights to publish, use, adapt, edit, and/or modify such entry in any way and in any and all media, without limitation, and without consideration or acknowledgment to the entrant and without additional compensation, except where prohibited by law.
By entering, participants release The Positive Way, affiliates, subsidiaries, advertising/promotional agencies, and the employees, officers, directors, and agents of the above organizations from any and all liability for any injuries, losses, or damages of any kind caused by participation in the contest or the acceptance, possession, or use/misuse of a prize or participation in any prize-related activities.
WINNERS LIST/OFFICIAL RULES
The winning entrant's first name, initial of his or her last name, and city of residence will be posted online on or about Wednesday, December 30, 2009.
